Terms & Conditions

Welcome to Chup. These Terms & Conditions ("Terms") govern your use of the Chup app and website (together, "Chup"), operated by everBetter Innovations (everbetter.site) ("we", "us", "our"). By signing in to or using Chup, you agree to these Terms. If you don't agree, please don't use Chup.

What Chup is

Chup is a technology platform — your "Café Passport". We provide the software that lets you collect digital stamps at participating cafés and businesses ("vendors") and keep track of the rewards those vendors choose to offer. Chup provides the technology only. The vendors run their own loyalty programs and are independent third parties — they are not our agents, partners, or employees.

Your account

You sign in to Chup with your Google account. You're responsible for keeping access to that account secure and for activity that happens under your Chup account. You agree to provide accurate information and to keep it up to date. You must be old enough to form a binding contract in your country to use Chup.

Collecting stamps & rewards

• Stamps and rewards have no cash value, can't be exchanged for cash, and aren't transferable between people unless we say otherwise.
• Each vendor decides its own program — how many stamps make a card, what the reward is, and how rewards are redeemed — and may change, pause, or end it at any time.
• Rewards are provided and honoured by the vendor, not by Chup.
• Stamps must be earned through genuine visits. Creating or claiming stamps or rewards you didn't earn is prohibited.

Vendors are independent

The cafés and businesses on Chup are independent third parties. To the fullest extent permitted by law, Chup is not responsible or liable for anything within a vendor's control, including:

• a vendor's products, food, drinks, service, premises, or safety;
• a vendor's loyalty offers, or its decision to change, pause, close, or refuse to honour a program or reward;
• a vendor's conduct, statements, disputes with you, or how it treats you;
• a vendor's own handling of your personal data at its premises or in its own systems.

Any dispute about a purchase, product, reward, or service is between you and the vendor.

Running a café on Chup

If you use Chup to run a loyalty program for your café or business, additional Vendor Terms apply to you (covering your responsibilities, staying active, leaderboard competitions, table tents & stickers, and use of the Chup logo), on top of these Terms. Those Vendor Terms are for vendors and don't affect you as a regular Chup customer.

Acceptable use

You agree not to misuse Chup — including committing fraud, tampering with stamps or rewards, disrupting the service, attempting to access other people's accounts, or copying, reverse-engineering, or reselling the platform.

Your responsibilities

You're responsible for the device, browser, and internet connection you use to access Chup, and for keeping your account credentials secure. Chup may not work on every device or network, and features may depend on services we don't control (such as Google sign-in, maps, or your camera).

Our brand & content

The Chup name, logo, and the app itself belong to everBetter Innovations. You may not use our brand without our permission. Café names and logos belong to their respective owners.

Availability & changes

Chup is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't warrant that Chup will be uninterrupted, error-free, secure, or always available. We may add, change, or remove features, and may suspend or discontinue the service. We'll try to give reasonable notice of significant changes where we can.

Events beyond our control

Chup is not liable for any failure or delay caused by events beyond our reasonable control — including internet, hosting, network, or power outages; failures of third-party services (such as Google, maps providers, or email delivery); device or browser issues; acts of government; or natural events.

Limitation of liability

To the fullest extent permitted by law:

• everBetter Innovations is not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, goodwill, data, or opportunity;
• everBetter Innovations is not liable for the acts, omissions, offers, products, or services of vendors or other third parties, or for anything outside Chup's reasonable control;
• our total aggregate liability to you for any claim relating to Chup is limited to the greater of (a) the total fees you paid us for the service in the 12 months before the event giving rise to the claim, or (b) BND 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law.

Data protection

We handle personal data in line with our Privacy Policy and the Personal Data Protection Order, 2025 of Brunei Darussalam. By using Chup you acknowledge that Privacy Policy.

Suspension & termination

We may suspend or close accounts that breach these Terms or misuse the service. You can stop using Chup at any time and request deletion of your account (see the Privacy Policy).

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the date above and, where appropriate, let you know in the app or by email. Continuing to use Chup after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Brunei Darussalam, and disputes are subject to its courts.
